this Court he the Said John Haymer took and the Said horse and Mare did there So grievously by burning disfigure disable and Abuse that the Said horse and Mare was very Much wronged & other harms to him the Said John Hawkins the Said John Haymer did do to the great damage of him the Sd John Hawkins and agt: ye. Peace of our Lord the King that now is. And whereupon the Said John Hawkins by Richard Macklin his Attorney complains yt. Whereas the Said John Haymer the twenty fifth day of October Anno Domi 1701 At Chester river in Kent County within the Juris =diction of this Court by force and Arms (that is to Say) with fire And Sword One horse and one Mare ye. proper horse and Mare of the Said John Hawkins he the Said John Haymer did take and the Said horse And Mare did then and there So greivously disfigure Abuse burn and disable that the Said horse and Mare was greivous: :ly injured And Wronged And other harms he the Said John Haymer unto him the Sd John Hawkins did do against the peace of our Lord the King that now is Whereupon the Said John Hawkins Says that he is Damnifyed and hath Sustained Damage to the Value of ten thousand pounds of tobacco and thereupon produceth this Suit . Earle his Attry Comes and Defends the force and Injury When &ca. prays leave to imparle hereunto untill next Cort which is granted him the Same day is given the plaintf. Also. At Which Sd Next Cort to wit the twenty Seventh day of Janry Anno Domi 170½ Comes as well the Sd plaintf. by his Attry Afd As the Sd Deft. by his Attry. afd who for plea Says yt. he is not guilty of the facts in the plaints decln Alledged agt. him And of this he puts himself upon the Conntrey Earle pr Dte But the Said Deft. by himself or his Attry Made No reply to the plea afd.
