           that behalf he the Said Edward prays Judg^t. for his debt and Dam=
           :ages to be Adjudged unto him       Macklin p^r que^r.
Reason : the Defend^t. hath not Shewed by his plea that the Services were done
           At the request of the Said Edward.    Demur^r Joyned Earle p^r. d^te ——
      Which reason of Demur^r being by the court considered. is overuled. And
      by consent of parties together with the approbⁿ. of the court it is proceed
      :ed upon, by the plaintifs Attorney to And after pleading, Who by way of
      Replication to the def^ts plea first above Mentioned Sayth that the S^d.
      Defend^t. ought not be Allowed any part of the Sume of tob^o. in the Def^ts.
      plea contained in bar of his the Said plaintifs Accon As the s^d. Defend^t.
      in his afd plea hath prayed and this he prays May be inquired of by the
      Country    Macklin p^r q^r.. And the plaint^f. in like Maner Earle p^r Defs^e.
      Whereupon Comand is given to the Sher^f of Kent County that he imediately
      Cause to come here twelve &c^a. by whom &c^a. who neither &c^a. because
      As well &c^a. Of which Said ~~[illegible]~~ precept the Sher^f Makes retⁿ that he
      has now here twelve &c^a. As by his precept it is comanded. To wit
      John Haymer Nicholas Marsey John Hollinsworth Patrick Obryan
      Richard Tinglingham Edward Carroll ffard^o. Ford John Hughs W^m.
      Robinson Math: Mason Thomas Carman & Samuell Tayler Who being
      Elected tryed and Sworn to Say the Truth in the premises do
      Say upon their Oaths, we of The Jury find for the Plaintif.
      Which being by the Court heard and understood It Is by them
      Considered that the Sayd Edward Chetham, this twenty Seventh day
      of January anno Domⁱ 170½, Recover against the Said Rob^t:
      Hawkshaw As well the Sume of Eight hundred and ninety
      pounds of Tobacco the debt in the declaration Specifyed
      As the Sum of three hundred and Eighty Seven    — pounds of
      tobacco Cost of Suit And the Defend^t. in Mercy &c^a.

the S^d Usher was Comitted into the Custody of the Sher^f for want
thereof, And y^e. cause Continued untill next Court
