   And the Said Thomas Howell by Michael Earle his Att^ry Comes &
   Defends the force and Injury when &c^a. and prays leave to Imp^rle
   hereunto untill next Court which is granted him the Same day is given
   the plaint^f. also : At which Said next Court to wit the twenty Seventh
   day of Jan^ry Anno Domⁱ 1702. Comes the Said P^rties by their Att^rys afd
   And the Said Thomas Howell in his own proper P^rSon likewise Comes
   into Court And Says that as to the Sume of one thousand and ninety
   nine pounds of tobacco the debt afd and balance of S^d aCount he can:
   :not Say but that he is and Stands Justly indebted unto the Said
   Edward Bathurst in the Same and is therefore willing y^t. Judg^t. be
   Entered Ag^t. him for the Same ball^a. of y^e. account afd ~
      Which by the Court being heard and fully understood its by
   them Considered this twenty Seventh day of Jan^ry afd that the afd
   Edward Bathurst recover against the Said Thomas Howell
   As well the Sume of one thousand and ninety nine pounds of
                                                                  also
   tobacco the balance of the Account afd As ^ the Sume of
   four hundred forty & Three ~~ pounds of tobacco Cost of Suit
   And that the Said Thomas Howell be in Mercy &c^a.
