      Deceased here prsent in Court in his proper person of a plea of trespass upon ye Case:
        as bÿ a Declan & acct thereunto annexed | filed in this Court, in Due form ) ye Same
      | more | att large ) maÿ appear, the Sd acct or bill amõunting in ye whole to ye Sume
      of thirtÿ pounds [illegible] Sixteen Shills & Six pence Sterg, but Creditt is Given (upon ye
      acct bÿ ye Sd pltf ) to ye Sd Deft for ye Sume of Sixteen pounds one Shill & Six pence
      Sterg. paid (att Severall times, as Apprs pr Sd acct) bÿ the Sd Testatr, and ^as to ye Reside | being
      ye Sume of fourteen pounds Sixteen Shills, ) The Sd Exr In his Sd Capacitie Saÿeth

   bÿ the Court untill this 24th Daÿ of augt 1703 when Comes as well the Deft in his propr

   The Chattells Debts and Creditts of Benñ Dollin late of ye Kingdome of England Deceased

   bÿ Richard Macklin his attrÿ Exhibitted to her majesties Justices of Kent Countÿ Court

   Judiciallÿ Setting his Certaine bill agt Michal Earle Gentn one of ye attrys of this Court for

   Kent Countÿ and here prsent in his proper prson of a plea of Trespass upon the Case/
  And whereupon ye Sd Jeremh bÿ Richard Macklin his Attrÿ Complaines that whereas ye Sd Binjamn in his life
  time yt is to Saÿ on ye 24th Daÿ of novembr annõ Dñi 1698 and att Divers other Daÿs & times ~
  afterwards to witt ye 14th Daÿ of 9br ano 1699 ye 28th Daÿ of aprill ano Dñi 1700 & on ye 1st Daÿ of Julÿ
   anno Dñi 1700 att ye Speciall Instance & request of ye Sd Michael at Chester River in Kent
   Countÿ wthin the Jurisdiction of this Court, Did Sell & Deliver unto ye Sd Michael Divers
   Goods warres and merchantdizes amõunting to ye Sume of Six thousand two hundred fiftÿ three
   pounds of tobo & ½ pound of tobo as bÿ an acct thereof to this Declan annexed and here in Court
   produced ye Same apprs: in Condrcon thereof the Sd Michall upon himselfe assumed and unto
   the Sd Benjn in his life time faithfullÿ promissed yt he ye Sd Michael when thereunto af:
   terwards required ye Sd 6253ls½ of tobo unto ye afsd Benjn he wo’ld well & truelÿ paÿ
   and alltho’ ye Sd Michael hath Satisfied and paid two thousand two hundred & fifteen pds
   of tobacco prt of ye afsd 6253ls½ of tobo yett as to ye residue being [40]38ls½ of tobo ye afsd
   Michal his afsd assumption & promisse Soe as afsd made not regarding or minding but ~
   plotting Contriveing & fraudulentÿ Intending
