      Kent Countÿ Court Ex^r of y^e last will & testam^t of Edward ffreÿ late of Kent Countÿ ~
      Deceased here p^rsent in Court in his proper person of a plea of trespass upon y^e Case:
        as bÿ a Declaⁿ & acc^t thereunto annexed | filed in this Court, in Due form ) y^e Same
      | more | att large ) maÿ appear, the S^d acc^t or bill amõunting in y^e whole to y^e Sum^e
      of thirtÿ pounds ~~[illegible]~~ Sixteen Shills & Six pence Ster^g, but Creditt is Given (upon y^e
      acc^t bÿ y^e S^d pltf ) to y^e S^d Def^t for y^e Sum^e of Sixteen pounds one Shill & Six pence
      Ster^g. paid (att Severall times, as App^rs p^r S^d acc^t) bÿ the S^d Testat^r, and ^^{as to} y^e Reside | being

Micha^l Earle~	\| of trespass upon the Case and y^e S^d Michael Earle in his prop^r person comes
	and w^th leave Imp^rles untill next Court & he hath it the Same Daÿ was Given y^e [pltf]

   ffrom w^ch Said next Court being the 24^th Daÿ of June 1703 This Cause was Continued ^allsoe
   bÿ the Court untill this 24^th Daÿ of aug^t 1703 when Comes as well the Def^t in his prop^r
   person as allsoe y^e afs^d pltf bÿ his S^d att^rÿ and y^e Cause Standing for trÿall y^e pltfs
   bill as afs^d was read in these words viz^t:/

Marÿland	\| Ss Be it remembered y^t on y^e twentÿ fifth daÿ of March in y^e Second year of her Maj^ties.
Kent Countÿ	\| Reigne Anne &c^a anno Dñi 1703 Came into Court Jerem^a Miles adm^r of all & Singular
	The Chattells Debts and Creditts of Benñ Dollin late of y^e Kingdome of England Deceased
	bÿ Richard Macklin his att^rÿ Exhibitted to her majesties Justices of Kent Countÿ Court
	Judiciallÿ Setting his Certaine bill ag^t Micha^l Earle Gentⁿ one of y^e att^rys of this Court for
	Kent Countÿ and here p^rsent in his proper p^rson of a plea of Trespass upon the Case/

And whereupon y^e S^d Jerem^h bÿ Richard Macklin his Att^rÿ Complaines that whereas y^e S^d Binjamⁿ in his life
time y^t is to Saÿ on y^e 24^th Daÿ of novembr annõ Dñi 1698 and att Divers other Daÿs & times ~
afterwards to witt y^e 14^th Daÿ of 9^br an^o 1699 y^e 28^th Daÿ of aprill an^o Dñi 1700 & on y^e 1^st Daÿ of Julÿ
   anno Dñi 1700 att y^e Speciall Instance & request of y^e S^d Michael at Chester River in Kent
   Countÿ w^thin the Jurisdiction of this Court, Did Sell & Deliver unto y^e S^d Michael Divers
   Goods warres and merchantdizes amõunting to y^e Sum^e of Six thousand two hundred fiftÿ three
   pounds of tob^o & ½ pound of tob^o as bÿ an acc^t thereof to this Declaⁿ annexed and here in Court
   produced y^e Same app^rs: in Condrcon thereof the S^d Michall upon himselfe assumed and unto
   the S^d Benjⁿ in his life time faithfullÿ promissed y^t he y^e S^d Michael when thereunto af:
   terwards required y^e S^d 6253^ls½ of tob^o unto y^e afs^d Benjⁿ he wo’ld well & truelÿ paÿ
   and alltho’ y^e S^d Michael hath Satisfied and paid two thousand two hundred & fifteen pds
   of tobacco p^rt of y^e afs^d 6253^ls½ of tob^o yett as to y^e residue being [40]38^ls½ of tob^o y^e afs^d
   Michal his afs^d assumption & promisse Soe as afs^d made not regarding or minding but ~
   plotting Contriveing & fraudulentÿ Intending
