FOR the purpose of allowing the Board to impose a certain
penalty in lieu or in addition to suspension or
revocation of a license; requiring that any penalties
collected be paid to the general fund of the State; and
granting the Board authority to adopt rules and
regulations to set standards for such penalties.

Section 378A

Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health

378A.

(A)  IN LIEU OF OR IN ADDITION TO SUSPENSION OF THE
LICENSE OF AN OPTOMETRIST, THE BOARD MAY IMPOSE A PENALTY OF
NOT MORE THAN $5,000.

(B)  IN ADDITION TO REVOCATION OF THE LICENSE OF AN
OPTOMETRIST, THE BOARD MAY IMPOSE A PENALTY OF NOT MORE THAN
$5,000.

(C)  THE BOARD SHALL HAVE THE POWER AND DUTY TO ADOPT
RULES AND REGULATIONS TO SET STANDARDS FOR THE IMPOSITION OF
PENALTIES PURSUANT TO THIS SUBTITLE.

(D)  PENALTIES COLLECTED BY THE BOARD UNDER THIS
SECTION SHALL BE PAID OVER TO THE STATE TREASURER AND SHALL
BECOME A PART OF THE GENERAL FUND OF THE STATE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.
