Trespass on Grounds of a Public Institution

FOR the purpose of providing that the persons who are
presently authorized to deny access to public school
institutions may authorize a designee to carry out that
responsibility. FOR the purpose of authorizing an
additional official to deny access to the buildings or
grounds of certain public education institutions; and
providing that certain designees of an authorized
official or board may deny such access.

BY repealing and reenacting, with amendments,

Section 26-102(a)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Education

26-102.

(a) The GOVERNING BOARD, president, SUPERINTENDENT, OR
principal, [or governing board] of any public institution of
elementary, secondary, or higher education, OR THE DESIGNEE
OF THE BOARD OR OF OR A PERSON DESIGNATED IN WRITING BY THE
BOARD OR ANY OF THESE PERSONS, may deny access to the
buildings or grounds of the institution to any person who is
not a bona fide, currently registered student, or staff or
faculty member at the institution, and who does not have
lawful business to pursue at the institution or who acts in
a manner that disrupts or disturbs the normal educational
functions of the institution.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.
