13-146. AGREEMENT WITH TENANT TO ACQUIRE FACILITY.

(A)        IN GENERAL.

A PUBLIC BODY THAT ACTS AS A MORTGAGOR MAY AGREE WITH
THE TENANT OF ANY INDUSTRIAL PROJECT ACQUIRED BY THE PUBLIC
BODY UNDER THIS SUBTITLE THAT, WHEN THE MORTGAGE HAS BEEN
PAID IN FULL, THE TENANT MAY BUY OR OTHERWISE ACQUIRE THE
PROJECT.

(B)   TERMS OF AGREEMENT.

(1)   THE CONSIDERATION TO BE PAID BY THE TENANT
FOR THE INDUSTRIAL PROJECT MAY BE NOMINAL.

(2)   THE AGREEMENT MADE UNDER THIS SECTION IS NOT
SUBJECT TO ANY LAB THAT REQUIRES PUBLIC SALE.

The tern "public body" is substituted for
references to a "municipality or county". See

The defined term "industrial project" is

13-147. CONDEMNATION NOT AUTHORIZED.

THIS SUBTITLE DOES NOT CREATE OR ENLARGE ANY POWER OF A
PUBLIC BODY TO ACQUIRE AN INDUSTRIAL PROJECT BY
CONDEMNATION.
