A RESOLUTION ADOPTED UNDER THIS SECTION IS

ADMINISTRATIVE IN NATURE AND IS NOT SUBJECT TO REFERENDUM.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first two
clauses of the first sentence and the entire
second and third sentences of Art. 41, § 266W(a)
and from the last two sentences of § 266W(e).

Throughout this section, the term "public body"
is substituted for references to a "municipality
or county". See revisor's note to § 13-101(o) of
this subtitle.

As to subsection (a) of this section, the present
language is restated for simplicity as a formal
definition, and the term "resolution" is adopted
as the defined term in place of present
references to an "ordinance or resolution".

In subsection (a) (3), the present reference to a
"determination"          by the State Aviation

Administration is deleted as unnecessary given
the required approval of the Secretary of
Transportation.

13-142. RESOLUTION OF PUBLIC BODY — EXCEPTION.

IF, UNDER A POWER GRANTED TO IT OTHER THAN BY THIS
SUBTITLE, A PUBLIC BODY ACQUIRES ALL OR ANY PART OF AN
INDUSTRIAL PROJECT AND INCURS COSTS RELATING TO IT BEFORE
AUTHORITY APPROVAL OF THE LOAN:

(1)       THE PUBLIC BODY MAY PARTICIPATE FULLY IN THE
PROVISIONS OF THIS SUBTITLE AS TO THAT PROJECT;

(2)       THE PROVISIONS OF THIS SUBTITLE THAT RELATE
TO ACQUISITION BY A PUBLIC BODY SHALL BE CONSIDERED TO BE
COMPLIED WITH; AND

(3)       THE PUBLIC BODY MAY BE REIMBURSED FOR ITS
COST OF PROJECT FROM THE PROCEEDS OF THE MORTGAGE.

REVISOR'S NOTE: This section is new language derived

eighth sentences of Art. 41, § 266W (a).

The term "public body" is substituted for the
references to a "municipality or county". See
revisor's note to § 13—101(o) of this subtitle.

The term "cost of project" is defined in i
13-101(c) of this subtitle.
