Ch. 23

SECTION 1. BE IT ENACTED BY THE, GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 2B - Alcoholic Beverages

98A.

In Garrett County, notwithstanding any other provisions
of this subtitle and except on [Sundays and] New Year's Day,
holders of any class licenses issued under this article may
not sell alcoholic beverages between the hours of 2 a.m. and
6 a.m. on any day of the week or [at any time on Sunday
after 2 a.m.] BETWEEN 2 A.M. AND 1 P.M. ON SUNDAY. However,
this section is subject to the provisions of § 89 (j) of
this article regarding sales on New Year's Eve or New Year's
Day regardless of the day of the week on which December 31
and January 1 fall.

SECTION 2. AND BE IT FURTHER ENACTED, That before this
Act becomes effective it shall first be submitted to a
referendum of the legally qualified voters of Garrett County
at the general primary election to be held in November May
of 1980. The cost of the special election, if any, shall be
paid by the Board of County Commissioners. The Board of
County Commissioners and the Board of Supervisors of
Election of Garrett County shall do those things necessary
and proper to provide for and hold the referendum here
required. There shall be printed on the ballots or ballot
labels to be used at this election the title of this Act and
underneath the title, on separate lines, a square or box to
the right of and opposite the words: "For Sunday Alcoholic
Beverage Sales" and a corresponding square or box to the
right of and opposite the words "Against Sunday Alcoholic
Beverage Sales" so that each voter of the county may
designate his or her decision for or against the provisions
of this Act. If a majority of the votes cast in the
election are "For Sunday Alcoholic Beverage Sales" the
provisions of this Act shall become effective on December
15, 1980 30 days after the date of the primary election, but
if a majority of the votes cast in the election are "Against
Sunday Alcoholic Beverage Sales" the provisions of this Act
shall be of no effect and null and void.

SECTION 3. AND BE IT FURTHER ENACTED, That subject to
the provisions of Section 2 herein and the sole purpose
of providing for the referendum therein required; this Act
shall take effect on July 1, 1980 this Act is hereby
declared to be an emergency measure and necessary for the
immediate preservation of the public health and safety and
having been passed by a yea and nay vote supported by
three-fifths of all the members elected to each of the two
Houses of the General Assembly, and subject to the
provisions of Section 2 above, and for the sole purpose of
providing for the referendum required therein, the same
shall take effect from the date of its passage.
