PERSON MAY BE INTERROGATED UNDER THIS SUBTITLE, THE BANK
COMMISSIONER MAY FILE A PETITION FOR ENFORCEMENT WITH THE
CIRCUIT COURT OF ANY COUNTY OR THE SUPERIOR COURT OF
BALTIMORE CITY.

(2) ON PETITION BY THE BANK COMMISSIONER, THE
COURT MAY ORDER THE PERSON TO ATTEND AND TESTIFY OR PRODUCE
EVIDENCE.

REVISOR'S NOTE: This section is new language derived
without substantive change front Art. 66. §§ 53.
54, and 55.

The last sentence of present Art. 66, § 55, which
deals with contempt of court, is deleted as
unnecessary since the court has this power, in
any event, without need for any express statutory
statement here. In this regard, see CJ §
1-202(a) and its revisor's note.

As to subsection (d) of this section and the per
diem fee, the Bank Commissioner advises that the
$50 per diem fee does not cover the costs
incurred in these investigations.

12-315. ORDER TO STOP DOING BUSINESS.

(A)       BANK COMMISSIONER MAY ISSUE ORDER.

IF THE BANK COMMISSIONER FINDS THAT THE CONDUCT OF ANY
OTHER BUSINESS CONCEALS A VIOLATION OR EVASION OF THE
MARYLAND SECONDARY MORTGAGE LOAN LAW OR OF ANY RULE OR
REGULATION ADOPTED UNDER IT, THE BANK COMMISSIONER MAY ISSUE
A WRITTEN ORDER TO A LICENSEE TO:

(1)       STOP DOING BUSINESS AT ANY PLACE IN WHICH
THE OTHER BUSINESS IS CONDUCTED OR SOLICITED; OR

(2)       STOP DOING BUSINESS IN ASSOCIATION OR
CONJUNCTION WITH THE OTHER BUSINESS.

(B)       VIOLATION PROHIBITED.

A LICENSEE MAY NOT VIOLATE AN ORDER OF THE BANK
COMMISSIONER ISSUED UNDER THIS SECTION.

12-316. SUSPENSIONS AND REVOCATIONS.

SUBJECT TO THE BEARING PROVISIONS OF § 12-317 OF THIS
SUBTITLE, THE BANK COMMISSIONER MAY SUSPEND OR REVOKE THE
LICENSE OF ANY LICENSEE, IF THE LICENSEE, OR ANY OWNER,
DIRECTOR, OFFICER, MEMBER, PARTNER, STOCKHOLDER, EMPLOYEE,
OR AGENT OF THE LICENSEE:
