(E) FINDINGS OF COMMISSIONER.
THE COMMISSIONER SHALL MAKE FINDINGS ON ANY WRITTEN
COMPLAINT MADE UNDER THIS SECTION AND SEND A COPY OF THE
FINDINGS TO EACH PERSON INVOLVED IN THE COMPLAINT.
(F) REFUSAL TO PERMIT INVESTIGATION.
A PERSON MAY NOT KNOWINGLY REFUSE TO PERMIT THE
COMMISSIONER TO CONDUCT ANY INVESTIGATION OR EXAMINATION
AUTHORIZED BY THIS SECTION.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 83, § 162
and the fourth clause of § 163.
In subsection (b) (2) of this section, the present
reference to inspection by "any person duly
designated by {the Commissioner}" is deleted as
unnecessary since nothing precludes the
Commissioner from delegating these powers.
In subsection (d) of this section, the last
sentence of present Art. 83, § 162 (b), which
deals with contempt of court, is deleted as
unnecessary since the court has this power, in
any event, without need for any express statutory
statement here. See CJ § 1—202(a) and its
revisor's note.
In subsection (d) (1) of this section, the
reference to an "appropriate" court of Baltimore
City is substituted for the reference to any
"civil" court of Baltimore City to reflect the
organization of the courts of Baltimore City, in
which certain types of actions are brought in
specific civil courts.
The first clause of the second sentence of
present Art. 83, § 162(c), which states that an
"investigation, notice and hearing shall be in
accordance with the provisions of this subtitle",
is deleted as unnecessary.
11-414. SUSPENSIONS AND REVOCATIONS.
(A) GROUNDS AVAILABLE.
SUBJECT TO THE HEARING PROVISIONS OF § 11-415 OF THIS
SUBTITLE, THE COMMISSIONER MAY SUSPEND OR REVOKE THE LICENSE
OF ANY LICENSEE, IF:
(1) THE LICENSEE KNOWINGLY OR WITHOUT EXERCISING
DUE CARE:
(I) VIOLATES ANY PROVISION OF THIS
SUBTITLE OR OF ANY OTHER LAW THAT REGULATES AGREEMENTS; OR
