Ch. 33

(1)   THE COMMISSIONER MAY EMPLOY THE STAFF,
INCLUDING INVESTIGATIVE, SECRETARIAL, AND CLERICAL
EMPLOYEES, THAT IS NECESSARY FOR THE EFFICIENT
ADMINISTRATION OF THE OFFICE.

(2)   THE STAFF IS ENTITLED TO THE COMPENSATION
PROVIDED IN THE STATE BUDGET.

(B) EMPLOYEES TO DEVOTE FULL-TIME.

EACH EMPLOYEE OF THE COMMISSIONER SHALL DEVOTE
FULL-TIME TO THAT EMPLOYEE'S DUTIES.

REVISOR'S NOTE: This section is new language derived
without substantive change from Act. 41, §
192A(b).

In subsection (a) of this section, the present
statement that the power of the Commissioner to
employ a staff is "subject to the approval of the
Secretary of Licensing and Regulation" is deleted
as unnecessary in light of Art. 41, §221B(c),
which states that "(t}he appointment or removal
of personnel by any board, commission, division,
or other agency within the jurisdiction of the
Department of Licensing and Regulation shall be
subject to the approval of the Secretary...".
See also § 11-105 of this subtitle.

11-105. AUTHORITY OF SECRETARY.

THE COMMISSIONER EXERCISES THE POWERS AND PERFORMS THE
DUTIES OF THE OFFICE SUBJECT TO THE STATUTORY AUTHORITY OF
THE SECRETARY.

REVISOR'S NOTE: This section is new language derived
without substantive change from the second
sentence of Art. 41, § 192A(a).

As to the general authority of the Secretary,
see, e.g., Art. 41, § 221 et seq. of the Code.

The first sentence of present Art. 41, § 192A(a),
which requires the Commissioner to "administer
and supervise the provisions of the Maryland
Consumer Loan Law", is deleted as unnecessary in
light of the specific powers and duties of the
Commissioner under that lav. See e.g., Subtitle
2 of this title, which gives the commissioner
responsibility for the licensing of lenders, and
CL § 12-304(b), which gives the commissioner
certain powers over advertising by licensees.

The third sentence of present Art. 41, § 192A(a),
as to reports of criminal violations of the
Maryland Consumer Loan Law to the State's
