The term "shares" is substituted for "free
shares" to encompass guaranty stock associations.

The General Assembly may wish to consider whether
the stockholders should be given rights of appeal
for findings still at the agency level.

The present reference to an appeal to a Baltimore
City circuit court is deleted as included in the
phrase "circuit court for the county".

"Board of Commissioners" and "savings and loan
association" are defined in § 8-101 of this
title.

"County" is defined in § 1-101 of this article.

8-406. JUDICIAL REVIEW.

(A)       APPEAL.

IN AN APPEAL UNDER § 8-405 OF THIS SUBTITLE, THE APPEAL
TAKEN SHALL BE SUBJECT TO THE PROVISIONS OF THE
ADMINISTRATIVE PROCEDURE ACT.

(B)       APPELLATE COURTS.

ANY PARTY TO THE PROCEEDINGS MAY APPEAL THE DECISION OF
THE COURT TO THE COURT OF SPECIAL APPEALS.

8-407. ENFORCEMENT OF ORDER.

IF THE BOARD OF COMMISSIONERS FINDS THAT A SAVINGS AND

OR EMPLOYEES HAS FAILED TO COMPLY WITH A FINAL ORDER ISSUED
BY THE BOARD OF COMMISSIONERS OR THE DIVISION DIRECTOR, THE
BOARD OF COMMISSIONERS MAY INSTITUTE PROCEEDINGS TO ENJOIN
THE CONTINUED VIOLATION OF THE ORDER.
