161H(b) and the first sentence of (c).

In subsection (a) of this section, the phrase
"savings and loan association named in the order"
is substituted for "the directors of the
association or their representatives". Since in
§ 8-401 of this subtitle, service of the order is
on the president or "whomever the association
designates", it would be inconsistent to bind the
effectiveness of the order to anyone other than
the person served, or as in this revision, to the
association, as the proper party.

In subsection (b) of this section, the tern
"savings and loan association" is substituted for
"one appears on behalf of the association" as
being the proper party.

In subsection (c)(2) of this section, "a savings
and loan association that is a party to the
proceedings" is substituted for "the association
affected thereby".

As to injunctions for enforcing a final order of
the Director, see § 8—407 of this subtitle.,

"Board of Commissioners", "Division Director",
and "savings and loan association" are defined in
§ 8-101 of this title.

8-403. BOARD OF COMMISSIONERS' HEARINGS.

(A)   IN GENERAL.

WITHIN 30 DAYS AFTER AN APPEAL IS FILED UNDER § 8-402
OF THIS SUBTITLE, THE BOARD OF COMMISSIONERS SHALL HOLD A
HEARING.

(B)   SUBPOENAS.

(1)   THE BOARD OF COMMISSIONERS, ON ITS OWN
MOTION OR AT THE REQUEST OF ANY PARTY, INCLUDING ANY
INTERVENING PARTY, MAY ISSUE A SUBPOENA TO COMPEL ATTENDANCE
AND TESTIMONY OR THE PRODUCTION OF RECORDS AT A HEARING
UNDER SUBSECTION (A) OF THIS SECTION. THE SUBPOENA SHALL:

(I)   BE SIGNED BY THE DIVISION DIRECTOR OR
A MEMBER OF THE BOARD OF COMMISSIONERS; AND

(II)   BE SERVED IN PERSON BY THE SHERIFF OF
ANY COUNTY IN WHICH SERVICE CAN BE MADE OR BY ANY INDIVIDUAL
WHO IS 18 YEARS OLD OR OLDER.

(2)   FOR GOOD CAUSE AND AFTER NOTICE, THE BOARD
OF COMMISSIONERS MAY QUASH OR MODIFY ITS SUBPOENA IF THE
EFFECT OF THE SUBPOENA IS UNREASONABLE, OPPRESSIVE, OR
UNDULY BURDENSOME.
