Senate Bill No. 1078
AN ACT concerning

Harford County - Pawnbrokers

FOR the purpose of requiring individuals to obtain a license
from the Harford County Department of Inspections,
Licenses and Permits, prior to doing business as a
pawnbroker; requiring each licensed pawnbroker to file
certain reports with the Harford County Sheriff's
department; requiring each licensed pawnbroker to keep
certain records and use certain forms; providing a
penalty for violations of this Act; and relating
generally to pawnbrokers in Harford County.

Dear Mr. President:

    

     In accordance with Article II, Section 17 of the

Maryland Constitution, I have today vetoed Senate Bill 1078.

The bill repeals the Public Local Laws of Harford
County regarding the licensing and reporting obligations of
pawnbrokers and adds new provisions to Article 56 of the
Annotated Code of Maryland. The only substantive difference
between the local law repealed and new provisions added to
the Annotated Code is that the new provisions of Article 56
contain a penalty provision.

     The attorney General has advised me that this bill
violates Article X1-A of the Maryland Constitution, which
provides chartered counties with the exclusive power to
enact local laws on any subject covered by the Express
Powers Act, under Article 25A of the Maryland Annotated
Code. A copy of the Opinion of the Attorney General is
attached and should be considered a part of this veto
message.

      For the reason stated, I have decided to veto Senate

Bill 1078.
