LAWS OF MARYLAND

Ch. 885

[No person shall possess any smokeless powder or other
explosives necessary for the manufacture of ammunition for
small arms unless he has obtained a license to possess such
explosives pursuant to the provisions of § 28 of this
subtitle. No person who has obtained a license pursuant to
the provisions of subsection (d) of § 28 of this subtitle
for the purpose of hand manufacturing ammunition for small
arms or for any other nonbusiness purpose shall possess more
than 10 pounds of smokeless powder and other explosives
necessary for the manufacture of ammunition for small arms
at any one time unless the amounts and the place and
conditions of storage of such explosives have been approved
by the State Fire Marshal, and unless such explosives are
stored in conformance with the terms of such approval]

(A)  A PERSON MAY POSSESS UP TO 50 10 5 POUNDS OF
SMOKELESS POWDER FOR THE LOADING OR RELOADING OF SMALL ARMS
AMMUNITION AND UP TO 25 5 POUNDS OF BLACK POWDER OF A TYPE
SUITABLE FOR THE LOADING OR RELOADING OF SMALL ARMS
AMMUNITION OR FOR USE IN THE LOADING OF ANTIQUE ARMS OR
REPLICAS OF ANTIQUE ARMS WITHOUT A LICENSE TO POSSESS
EXPLOSIVES, EXCEPT AS PROVIDED IN SUBSECTION (D). HOWEVER,
THE PERSON SHALL STORE THESE EXPLOSIVES IN THEIR ORIGINAL
SHIPPING CONTAINERS. ADDITIONALLY, THE PERSON MAY POSSESS
THESE EXPLOSIVES ONLY FOR PERSONAL USE, WHICH IS CONFINED
STRICTLY FOR USE IN FIREARMS.

(B)  A PERSON MAY NOT POSSESS AT ANY TIME OR STORE IN
ANY ONE PLACE A QUANTITY OF SMOKELESS POWDER OR BLACK POWDER
OF A TYPE SUITABLE FOR USE IN FIREARMS IN EXCESS OF THOSE
QUANTITIES SET FORTH IN SUBSECTION (A) OF THIS SECTION
WITHOUT FIRST OBTAINING A LICENSE TO MANUFACTURE, DEAL IN,
OR POSSESS EXPLOSIVES UNDER § 28 OF THIS SUBTITLE. A PERSON
WHO IS LICENSED FOR POSSESSING EXPLOSIVES FOR USE IN

FIREARMS UNDER § 28(D) OF THIS SUBTITLE MAY POSSESS

QUANTITIES OF EXPLOSIVES UP TO THE AMOUNT ALLOWED IN

APPLICABLE UNITED STATES LAWS OR REGULATIONS FOR THE

POSSESSION OF EXPLOSIVES.

(C)  A PERSON MAY NOT ENGAGE IN THE BUSINESS OF LOADING
OR RELOADING SMALL ARMS AMMUNITION WITHOUT FIRST OBTAINING A
LICENSE TO DEAL IN EXPLOSIVES UNDER § 28(B) OF THIS
SUBTITLE.

(D) (1) A PERSON MAY NOT POSSESS OR STORE EXPLOSIVES
FOR USE IN FIREARMS IN ANY QUANTITY IN MULTIFAMILY
DWELLINGS, APARTMENTS, DORMITORIES, HOTELS, SCHOOLS OR OTHER
PUBLIC BUILDINGS, OR BUILDINGS OR STRUCTURES OPEN FOR PUBLIC
USE.

(2) HOWEVER, THE STATE FIRE MARSHAL MAY ISSUE A
PERMIT TO ALLOW TEMPORARY POSSESSION OF EXPLOSIVES FOR USE
IN FIREARMS IN A BUILDING OR STRUCTURE OPEN FOR PUBLIC USE.
