to the distribution and use of certain paraphernalia

for the administration of controlled dangerous

substances; and making this Act an emergency measure.
defining drug paraphernalia; specifying certain
criteria and factors to be considered in determining if
something is drug paraphernalia; prohibiting the use,
or possession with intent to use drug paraphernalia;
prohibiting the possession or delivery of drug
paraphernalia for certain purposes; providing a
separate offense with more severe penalties for
delivery of drug paraphernalia by a person of a certain
age to a minor; providing for the forfeiture of
property which is drug paraphernalia or controlled
paraphernalia; specifying certain penalties for
violations of the provisions of this Act; providing
that local jurisdictions may enact laws on this
subject; and making this Act an emergency measure.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 27 - Crimes and Punishments

287A.

(A) THE FOLLOWING WORDS AND PHRASES AS USED IN THIS
SECTION HAVE THE FOLLOWING MEANINGS UNLESS THE CONTEXT
OTHERWISE REQUIRES:

(1) "COCAINE SPOON" MEANS A SPOON WITH A BOWL SO
SMALL THAT THE PRIMARY USE FOR WHICH IT IS REASONABLY
ADAPTED OR DESIGNED IS TO HOLD OR ADMINISTER COCAINE, AND
WHICH IS SO SMALL AS TO BE UNSUITED FOR THE TYPICAL, LAWFUL
USES OF A SPOON. A COCAINE SPOON MAY OR MAY NOT BE LABELED
AS A "COCAINE" SPOON OR "COKE" SPOON.

(2) "MARIJUANA PIPE" OR "HASHISH PIPE" MEANS A
PIPE CHARACTERIZED BY A BOWL WHICH IS SO SMALL THAT THE
PRIMARY USE FOR WHICH IT IS REASONABLY ADAPTED OR DESIGNED
IS THE SMOKING OF MARIJUANA OR HASHISH, RATHER THAN THE
