of this section; all the fines to be imposed under this
section shall be paid to the State.
(d) This section is not to apply to apothecaries and
such apothecaries may sell on Sunday drugs, medicines, and
patent medicines as on weekdays; and this section shall not
apply to the sale of newspapers and periodicals.
[(e) In addition to those articles which may now be
lawfully sold, disposed of, bartered, dealt in or given away
in Howard County on Sunday, retailers may sell, dispose of,
barter, deal in or give away on Sunday in Howard County the
following: (1) medical supplies and medicines, (2) necessary
and essential toilet articles, (3) antique and specialty
items, souvenirs, pottery and chinaware, (4) vegetables,
eggs, dairy products, fresh meat, including the cutting and
processing thereof, and smoked or cured meats, (5) food
prepared for human consumption which is consumed on the
premises where sold, (6) all items necessary for the repair
and maintenance of motor vehicles, the furnishing of which
is immediately essential to the well-being or safety of the
traveling public]
[(f)] (E) In Allegany County this section shall not
apply to or prohibit retail sales on any Sunday by:
(1) Food stores, drugstores, bakery or baked
goods stores, newsstands, selling and/or delivering
newspapers and periodicals, gasoline service stations,
nurseries or shops selling flowers and plants, or roadside
vending stands selling fruits, vegetables, or plants and
flowers; provided that, for the entire time during which any
such retail establishment is open on any Sunday, not more
than four persons, including any owner, manager, assistant
manager, or delivery personnel, are employed by the retail
establishment or working therein, regardless of the number
of leased departments, concession areas, booths, or stalls
located therein; and
(2) Restaurants, lunchrooms, or ice-cream
parlors.
Any violation of this subsection shall be prosecuted as
provided for in subsection (c) of this section.
[(g)] (F) This section shall not apply (1) to any
person who conscientiously believes that the seventh day of
the week ought to be observed as the Sabbath and who
actually refrains from secular business and labor on that
day, and whose business establishment or establishments or
employer's business establishment or establishments (whether
a sole proprietorship, partnership or corporation) are
actually closed on that day; or (2) to any person who
conscientiously believes that the Sabbath begins at sundown
on Friday night and ends at sundown on Saturday night and
who actually refrains from secular business and labor during
such period, and whose business establishment or
