Ch. 864

(g) All recreational activities, sports, and
amusements are permitted on Sunday.

(h) Nothing in this section shall be deemed or
construed to amend other provisions of law with reference to
the prohibition of work, sport, business, alcoholic beverage
sales, or the service of process on Sunday, nor shall
anything herein be construed to permit any new or used car
dealer to sell, dispose, barter, deal in, deliver, give
away, show or offer for sale any motor vehicle or any
certificate of title for any motor vehicle on Sunday.

(i) The State's Attorney of Baltimore County may
petition the Circuit Court to enjoin any violation of this
section.

(j) Any person, firm or corporation violating the
provisions of this section is guilty of a misdemeanor and,
upon conviction, is subject to the following penalties. The
first conviction is punished by a fine not to exceed one
hundred dollars ($100.00), a second conviction is punished
by a fine not to exceed five hundred dollars ($500.00), and
for a third or subsequent conviction by a fine not to exceed
five hundred dollars ($500.00) for each employee caused,
directed, or authorized to work in violation of this
section. Nothing contained herein shall be construed to
permit any fine upon any employee or agent who has been
caused or directed by his employer to violate the provisions
of this section.]

SECTION 2. AND BE IT FURTHER ENACTED, That new
Sections 534L, 534L-1, and 534L-2 be and they are hereby
added to Article 27 - Crimes and Punishments of the
Annotated Code of Maryland (1976 Replacement Volume and 1979
Supplement) to read as follows:

Article 27 - Crimes and Punishments

534L.

(A)  THE PROVISIONS OF THIS SECTION APPLY TO BALTIMORE
COUNTY AND BALTIMORE CITY.

(B)  (1) IT IS UNLAWFUL ON SUNDAY FOR ANY WHOLESALE OR
RETAIL ESTABLISHMENT TO CONDUCT BUSINESS FOR LABOR OR PROFIT
IN THE USUAL MANNER AND LOCATION OR TO OPERATE ITS
ESTABLISHMENT IN ANY MANNER FOR THE GENERAL PUBLIC.

(2) A WHOLESALE OR RETAIL ESTABLISHMENT MAY NOT
CAUSE, DIRECT, OR AUTHORIZE ANY EMPLOYEE OR AGENT TO ENGAGE
IN OR CONDUCT BUSINESS ON ITS BEHALF ON SUNDAY.

(C)  (1) THE STATE'S ATTORNEY OF BALTIMORE COUNTY MAY
PETITION THE CIRCUIT COURT TO ENJOIN ANY VIOLATION OF THIS
SECTION.
