Ch. 840

(c) In all cases, it shall be the right of the
defendant to have the report filed within the time specified
herein.

(d) In all cases, the order of court referring the
defendant for examination shall recite the applicable time
period for examination which may be extended by subsequent
order of court for good cause shown.

(D) FAILURE TO COMPLY WITH THESE TIME LIMITATIONS
SHALL NOT, OF ITSELF, RESULT IN DISMISSAL OF CHARGES. THE
COURT FOR GOOD CAUSE SHOWN MAY EXTEND SUCH TIME.

[(e) In cases in which the defendant remains in
custody after being referred for an examination, the
defendant shall be confined in a jail, detention center or
correctional facility for prisoners until the Department of
Health and Mental Hygiene can conduct an evaluation of the
prisoner. IN THOSE CASES WHERE THE COURT DEEMS IT
APPROPRIATE FOR THE HEALTH OR SAFETY OF THE DEFENDANT, THE
COURT MAY DIRECT THAT THE DEFENDANT BE CONFINED IN THE
HOSPITAL WING, MEDICAL WING, OR OTHER ISOLATED AND SECURE
UNIT IN THE JAIL, DETENTION CENTER OR CORRECTIONAL FACILITY
FOR PRISONERS. IF NO HOSPITAL WING, MEDICAL WING, OR OTHER
ISOLATED AND SECURE UNIT IN A JAIL, DETENTION CENTER OR
CORRECTIONAL FACILITY FOR PRISONERS IS AVAILABLE, THE COURT
MAY DIRECT THAT THE DEFENDANT BE COMMITTED TO AN APPROPRIATE
HOSPITAL OR MEDICAL FACILITY DESIGNATED BY THE SECRETARY OF
HEALTH AND MENTAL HYGIENE UNTIL THE SAID EVALUATION CAN BE
CONDUCTED. When the Department can conduct an evaluation of
the prisoner, the prisoner shall be transported by an agency
of the court to the evaluation facility designated by the
Department. After evaluation by the Department, the
prisoner shall be returned to the custodial facility by an
agency of the court.]

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.

FOR the purpose of exempting independent insurance adjusters
certain persons, firms, associations and corporations
independent insurance adjusters from requirements of
private detective licensing; and making stylistic
