of the Governor, a deputy secretary who shall have such
duties as are provided by law or delegated by the Secretary.
The deputy secretary shall serve at the pleasure of the
Secretary and shall receive such compensation as is provided
in the State budget.
(2) The Secretary shall appoint an assistant
secretary for environmental programs who shall have such
duties as are provided by law or delegated by the Secretary.
(3) (I) THE SECRETARY SHALL DELEGATE TO THE
ASSISTANT SECRETARY EACH ENVIRONMENTAL REGULATORY FUNCTION:
1. THAT WAS TRANSFERRED TO THE
SECRETARY OF HEALTH AND MENTAL HYGIENE BY EXECUTIVE ORDER
NUMBER 01.01.1980.04; AND
2. THAT HAS NOT BEEN REMOVED FROM
THE JURISDICTION OF THE DEPARTMENT OF HEALTH AND MENTAL
HYGIENE UNDER A SUBSEQUENT PROVISION OF LAW.
(II) THE ASSISTANT SECRETARY SHALL PERFORM
THOSE FUNCTIONS IN ADDITION TO ANY OTHER DUTIES AND
RESPONSIBILITIES DELEGATED BY THE SECRETARY.
SECTION 2. AND BE IT FURTHER ENACTED, That if
Executive Order .01.01.1980.04 is prevented from taking
effect pursuant to the provisions of Article II, Section 24
of the Constitution of Maryland, this Act is null and void
without the need of further action by the General Assembly.
the Secretary of Natural Resources and the Secretary of
Health and Mental Hygiene shall, on or before the first day
of the 1981 legislative session, report to the Senate
Finance Committee and the House Environmental Matters and
Appropriations Committees regarding the status of the
implementation of Executive Order .01.01.1980.04.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.
