The provisions of Art. 11, § 20 that relate to
credit unions now appear in § 6—303 of this
article.

5-202. EXAMINATION OF WITNESSES.

(A)       IN GENERAL.

THE BANK COMMISSIONER OR DEPUTY BANK COMMISSIONER MAY:

(1)   SUMMON ANY OFFICER, MANAGER, TRUSTEE,
EMPLOYEE, OR AGENT OF ANY BANKING INSTITUTION AND ANY OTHER
WITNESS THAT THE BANK COMMISSIONER THINKS PROPER;

(2)   ADMINISTER AN OATH TO THAT PERSON; AND

(3)   QUESTION THAT PERSON ABOUT THE AFFAIRS OF
THE INSTITUTION.

(B)   POWER NOT DELEGABLE.

THE BANK COMMISSIONER OR DEPUTY BANK COMMISSIONER MAY
NOT DELEGATE THE POWERS GRANTED BY SUBSECTION (A) OF THIS
SECTION.

(C)       INTERFERENCE WITH DUTIES PROHIBITED; PENALTY.

(1) A PERSON MAY NOT:

(I)       OBSTRUCT THE BANK COMMISSIONER OR ANY
PERSON ACTING FOR THE BANK COMMISSIONER IN THE PERFORMANCE
OF THE DUTIES OF THE BANK COMMISSIONER; OR

(II)       REFUSE TO APPEAR OR TESTIFY WITHOUT
GOOD CAUSE WHEN SUMMONED UNDER THIS SECTION.

(2)       ANY PERSON WHO VIOLATES ANY PROVISION OF

THIS SUBSECTION IS GUILTY OF A MISDEMEANOR AND ON CONVICTION

IS SUBJECT TO A FINE NOT EXCEEDING $1,000 OR IMPRISONMENT

NOT EXCEEDING 1 YEAR OR BOTH.

REVISOR'S NOTE: This section presently appears as Art.
11, § 8.

Subsection (b) of this section is new language
added for clarity. It is based on the present
reference to both the Bank Commissioner and the
Deputy Bank Commissioner, implying that the power
to summon witnesses was not intended to be
delegable to any other person.

The only other changes are in style.

The term "banking institution" is defined in §
1-101 of this article.
