AN ACT concerning

Medicaid - Reimbursement of Providers

FOR the purpose of authorizing and directing the Department
of Health and Mental Hygiene to reimburse those
Medicaid providers that operate related facilities that
are a distinct part of, directly operated by, or
operating a hospital and which also provide skilled,
comprehensive and intermediate services to patients on
the same method as the hospital is reimbursed for
services under certain provisions of law.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health

42-0.

(A) THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE,
MEDICAL ASSISTANCE ADMINISTRATION, SHALL REIMBURSE RELATED
INSTITUTIONS, INCLUDING EXTENDED CARE FACILITIES, SKILLED
NURSING FACILITIES, COMPREHENSIVE CARE FACILITIES, AND
INTERMEDIATE CARE FACILITIES AS THESE FACILITIES ARE
CLASSIFIED FROM TIME TO TIME BY-LAW OR REGULATION, IN THE
SAME MANNER AS IS APPLICABLE TO HOSPITALS, IF THE FACILITY:
IS A DISTINCT PART OF AN ACUTE OR CHRONIC HOSPITAL AND IS
LICENSED AS A RELATED INSTITUTION AS OF JULY 1, 1980.
