SECTION 22. AND BE IT FURTHER ENACTED, That any person
appointed to the position and serving as Chairman of the
Board of Contract Appeals of the Department of
Transportation, pursuant to Chapter 418 of the Acts of 1978,
and serving immediately prior to the effective date of this
Act, shall be the Chairman of the Maryland State Board of
Contract Appeals created by this Act. The individual shall
serve from July 1, 1981 to February 1, 1984 and shall retain
all of the rights, status, salary, and benefits that he was
entitled to prior to the repeal of the provisions of Chapter
418. Any part-time member of the Board of Contract Appeals
of the Department of Transportation appointed pursuant to
Chapter 418 of the Acts of 1978, and serving immediately
prior to the effective date of this Act, shall be a member
of the Maryland State Board of Contract Appeals created by
this Act, to serve on a part-time basis, until the
appointment and qualification of their successors as
provided in Section 1. All appeals pending before the Board
of Contract Appeals of the Department of Transportation as
of the effective date of this Act are transferred to the
Maryland State Board of Contract Appeals.

SECTION 23. AND BE IT FURTHER ENACTED, That if any
provision of this Act or the application thereof to any
person or circumstance is held invalid for any reason in a
court of competent jurisdiction, the invalidity does not
affect other provisions or any other application of this Act
which can be given effect without the invalid provision or
application, and for this purpose the provisions of this Act
are declared severable.

SECTION 24. AND BE IT FURTHER ENACTED, That all laws
or parts of laws, public general or public local, including
all laws or parts of laws enacted by the 1980 Session of the
General Assembly, that are inconsistent with this Act, are
superseded to the extent of the inconsistency.

SECTION 25. AND BE IT FURTHER ENACTED, That although a
presently existing obligation or contract right may not be
impaired in any way by this Act, the procedural provisions
of this Act, including those requiring review by the
Maryland State Board of Contract Appeals, may, at the option
of the contractor, apply to contracts in force on the
effective date of such provisions.

SECTION 26. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981. However, Section 2-101(e)
2-301(a) of Article 21 as enacted by Section 1 of this Act
shall take effect on June 1, 1980.
