Services] DIVISION OF CORRECTION in the exercise of the
powers hereinbefore contained to diversify its industries in
such a manner as not to work a hardship on any one
particular free industry.
(d) The [Department] DIVISION of Correction may
publish and distribute to the Department of Budget and
[Procurement] FISCAL PLANNING a schedule of prices for the
purchase of all such [products] SUPPLIES, provided that such
prices may not exceed the wholesale market (or equivalent)
rates for similar [products] SUPPLIES manufactured,
produced, or mined elsewhere in the State of Maryland. The
[Department] DIVISION of Correction also may consult and
cooperate with the Department of Budget and [Procurement]
FISCAL PLANNING and the representatives of such consuming
institutions, in establishing certain standards of
production, and with such Department and representatives
shall determine the style, design, and quality of the
[products] SUPPLIES of the producing institutions. Any
difference of opinion on prices, standards, styles, design,
and quality of such [product] SUPPLIES or products which may
arise between the [Department] DIVISION of Correction and a
representative of such Department or of any particular
consuming institution, agency, or subdivision of the State
shall be forthwith submitted for immediate arbitration to a
representative of the [Department] DIVISION of Correction, a
representative of the Department of Budget and [Procurement]
FISCAL PLANNING, and a representative of the State
Comptroller or to a representative of the [Department]
DIVISION of Correction of the particular consuming
institution or agency or subdivision, and of the State
Comptroller as the case may be, whose joint determination
shall be final and conclusive.
(e) The [Department] DIVISION may place prisoners at
labor upon State works whenever in the judgment of the
[Department] DIVISION the same shall be expedient and
proper, upon such terms as to it seem wise.
(f) The Division of Correction shall submit annually
to the Governor, to the Secretary of Public Safety and
Correctional Services and to the Secretary of Budget and
Fiscal Planning a complete financial report and program of
the operation of [state-use] STATE USE industries and of the
so-called [State-Use] STATE USE industries Fund, in the same
general manner and form as for the other operations and
programs of the Division of Correction, including full
information as to present and projected personnel and their
compensation; and the Governor and the secretaries shall
include data and figures from the report and program of
[state-use] STATE USE industries and of the [State-Use]
STATE USE Industries Fund in the preparation of the budget
and of the capital improvement bill.
(g) The [Department] DIVISION shall formulate a system
of records and accounting which at all times shall indicate
the source, nature, and extent of its purchases, and the
source, nature, and extent of its sales.
