work and payment therefor has not been made or that he is
being sued on any such bond OR OTHER SECURITY, a certified
copy of the bond, OF A CERTIFIED STATEMENT OF OTHER SECURITY
PROVIDED, OR OF EVIDENCE OF ANY TRUST ACCOUNT ESTABLISHED
which copy shall be prima facie evidence of the contents,
execution, and delivery of the original. BOND OR OTHER
SECURITY, AS APPLICABLE. Applicants shall pay for such
certified copies such reasonable fees as the State
Comptroller or the aforesaid officer shall fix to cover the
cost of preparation thereof.

SECTION 6. AND BE IT FURTHER ENACTED, That Section(s)
231M-2 of Article 41 - Governor - Executive and
Administrative Departments, of the Annotated Code of
Maryland be and it is hereby transferred, with amendments,
to be Section(s) 3-502 of the new Article 21 - Procurement,
of the Annotated Code of Maryland, to read as follows:

ARTICLE 21 - PROCUREMENT

[231M-2.] 3-502.

Notwithstanding any provision of [Section 8-614(e) of
the Transportation Article or Section 9-113 of the Real
Property Article] THIS SUBTITLE to the contrary, no NO
PROCUREMENT agency of the State [involved in purchasing
goods and services, including construction and repair
contracts,] may require bid, performance, and payment bonds
to be posted if the contract price is less than $25,000,
unless such bonds are required by federal law or regulation
or as a condition to federal assistance.

SECTION 7. AND BE IT FURTHER ENACTED, That section(s)
of the Annotated Code of Maryland be repealed, amended, or
enacted to read as follows:

ARTICLE 21 - PROCUREMENT

3-503.

PERFORMANCE BONDS OR OTHER SECURITY MAY BE REQUIRED FOR
ANY PROCUREMENT OF SUPPLIES AND SERVICES OVER $25,000 IF THE
CIRCUMSTANCES WARRANT, AS DETERMINED BY THE PROCUREMENT
OFFICER.

3-504.

(A) EACH BIDDER OR OFFEROR SHALL GIVE A BID BOND IF
THE CONTRACT PRICE IS ESTIMATED BY THE PROCUREMENT OFFICER
TO EXCEED $25,000. THE BID BOND SHALL BE PROVIDED BY A
SURETY COMPANY AUTHORIZED TO DO BUSINESS IN THIS STATE, OR
THE EQUIVALENT IN CASH, OR IN A FORM SATISFACTORY TO THE
PROCUREMENT OFFICER.
