the contract note and shall be liable only for the
reasonable value of the services performed and materials
supplied.

(e) Any person, whether an employee, prospective
employee or not with information concerning violations of
the requirements of this section may inform the Board [of
Public Works] which shall cause an immediate investigation
of the charges. If the Board concludes that the charges are
true it shall invoke the remedies set out in this section.

SECTION 4. AND BE IT FURTHER ENACTED, That Section(s)
3-108 of Article 40A - Maryland Public Ethics Law, of the
Annotated Code of Maryland be and it is hereby transferred,
with amendments, to be Section(s) 3-407 of the new Article
21 - Procurement, of the Annotated Code of Maryland, to read
as follows:

ARTICLE 21 - PROCUREMENT

[3-108.] 3-407.

Every written contract binding or purporting to bind
the State of Maryland, or any department, commission, agency
or branch thereof, to pay a sum of money in excess of
[twenty-five thousand dollars ($25,000)] $25,000 in any one
fiscal year for the purpose for which such contract is made
shall contain the following provision: "No employee of the
State of Maryland, or any department, commission, agency or
branch thereof, whose duties as such employee include
matters relating to or affecting the subject matter of this
contract, shall, while such employee, become or be an
employee of the party or parties hereby contracting with
said State of Maryland, or any department, commission,
agency or branch thereof." For purposes of this section, a
member of the General Assembly shall not be considered an
employee of the State of Maryland or of a department,
commission, agency or branch thereof. [In the event that
such contract does not contain the aforegoing provision, the
State of Maryland, or any department, commission, agency or
branch thereof, shall not be liable thereon.]

SECTION 5. AND BE IT FURTHER ENACTED, That Section(s)
9-113 of Article - Real Property, of the Annotated Code of
Maryland be and it is hereby transferred, with amendments,
to be Section(s) 3-501 to be under the new subtitle
"Subtitle 5. Bonds" of the new Article 21 - Procurement, of
the Annotated Code of Maryland, to read as follows:
