CHAPTER 728

(Senate Bill 776)

AN ACT concerning

Public Service Commission - Non-Merit System Employees

FOR the purpose of excluding the Executive Director and the
personal staff for the Commissioners of the Public
Service Commission from the merit system.

BY repealing and reenacting, with amendments,

Article 78 - Public Service Commission Law

Section 17

Annotated Code of Maryland

(1975 Replacement Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 78 - Public Service Commission Law

17.

(A)  [All] EXCEPT AS PROVIDED IN (B), ALL personnel of
the Commission [except the commissioners, the general
counsel, the people's counsel and the taxicab license
hearing officer,] shall be subject to and included in the
merit system established under Article 64A of this Code.

(B)  THE FOLLOWING ARE NOT SUBJECT TO OR INCLUDED IN
THE MERIT SYSTEM:

(1)  COMMISSIONERS;

(2)  EXECUTIVE DIRECTOR;

(3)  GENERAL COUNSEL;

(4)  PEOPLE'S COUNSEL;

(5)  PERSONAL STAFF FOR THE COMMISSIONERS; AND

(6)  TAXICAB LICENSE HEARING OFFICER.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.
