FOR the purpose of creating a Class H beer, wine, and liquor
license in Baltimore City to be issued to the operator
of a nonprofit organization and authorizing the
operator to keep for sale and sell all alcoholic
beverages at retail for consumption on the premises;
providing that the annual license fee shall be a
certain amount, defining a nonprofit organization; and
providing that a certain number of new liquor licenses
may be issued in a certain area of Baltimore City.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 2B - Alcoholic Beverages
24A.
(A) FOR THE PURPOSE OF THIS SECTION, A NONPROFIT
ORGANIZATION IS DEFINED AS AN ORGANIZATION OR GROUP OF
ORGANIZATIONS DESCRIBED IN § 5-501(C)(3) OF THE UNITED STATES
INTERNAL REVENUE CODE WHICH IS EXEMPT FROM INCOME TAX UNDER
§ 501(A) OF THE UNITED STATES INTERNAL REVENUE CODE.
(B) IN BALTIMORE CITY, A CLASS H BEER, WINE, AND
LIQUOR LICENSE SHALL BE ISSUED BY THE CLERK OF THE COURT OF
COMMON PLEAS FOR BALTIMORE CITY, IF THE PLACE OF BUSINESS IS
LOCATED IN THE CITY, AND SHALL AUTHORIZE THE OPERATOR OF A
NONPROFIT ORGANIZATION TO KEEP FOR SALE AND SELL ALL
ALCOHOLIC BEVERAGES AT RETAIL AT THE PREMISES DESCRIBED
THEREIN FOR CONSUMPTION ON THE PREMISES. THE ANNUAL LICENSE
FEE FOR THE LICENSE SHALL BE THE AMOUNT ESTABLISHED FOR A
CLASS B BEER, WINE, AND LIQUOR LICENSE IN § 19 OF THIS
ARTICLE AND SHALL BE PAYABLE TO THE CLERK BEFORE ANY LICENSE
IS ISSUED, WHICH FEE SHALL BE DISTRIBUTED AS PROVIDED IN
THIS ARTICLE.
