(E) UPON CONVICTION, WITHIN 18 MONTHS, OF A THIRD OR
SUBSEQUENT VIOLATION OF THIS SECTION, THE FINE SHALL BE
TRIPLE THAT IMPOSED BY SUBSECTION (C) OF THIS SECTION, AND
THE VEHICLE IN VIOLATION SHALL BE IMPOUNDED FOR 60 DAYS.
[(e)] (F) (e) (1) If the vehicle being operated at the
time the offense is committed is registered outside of this
State, or if the person responsible for the violation or the
person operating the vehicle is a nonresident of this State,
further proceedings shall be had as to the person under
Title 26 of this article or the vehicle shall be impounded
until the fine is paid or acceptable collateral posted.
(2) The impounding of the vehicle does not
include the cargo, and the cargo may not be held.
(3) If, after 90 days from the date the vehicle
was impounded, the fine has not been paid or acceptable
collateral posted, the vehicle may be sold at public auction
under the jurisdiction of the court to satisfy the fine,
accrued interest, and costs.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect contingent on the enactment into law of
either House Bill 231 or Senate Bill 85 of the 1980 Session
of the General Assembly. If neither House Bill 231 nor
Senate Bill 85 is enacted into law, this Act shall be null
and void without the necessity of further action by the
General Assembly.
SECTION 2 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.

security other than bonds; exempting certain persons
