Article 16A - Civil Defense

Section 7(a)

Annotated Code of Maryland

(1973 Replacement Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 16A - Civil Defense

7.

(a) (1) Each political subdivision of this State shall
establish a local organization for civil defense and
disaster preparedness in accordance with the State civil
defense and disaster preparedness plan and program and shall
participate in federal programs for civil defense and
disaster preparedness. Each local organization for civil
defense and disaster preparedness shall have a director who
shall be appointed by the Governor upon the recommendation
of the mayor, the executive, or governing body of the
political subdivisions, and who shall have direct
responsibility for the organization, administration and
operation of such local organization for civil defense and
disaster preparedness subject to the direction and control
of the mayor, executive, or governing body, under general
power of the Governor and Secretary of Public Safety and
Correctional Services. The local organization shall include
such positions and program as may be recommended from time
to time by the State Civil Defense and Disaster Preparedness
Agency to meet federal and State standards, subject to the
budgets of the local jurisdictions. EACH LOCAL ORGANIZATION
SHALL SUBMIT TO THE DIRECTOR A NUCLEAR EMERGENCY PLAN,
INCLUDING A PLAN FOR EVACUATION OF THE RESIDENTS OF THE
POLITICAL SUBDIVISION, IN CASE OF AN EMERGENCY OR MAJOR
DISASTER CAUSED BY A DANGEROUS RELEASE OF RADIATION.

(2) EACH LOCAL ORGANIZATION WHOSE JURISDICTION FALLS
WITHIN THE PLUME OR INGESTION ZONE OF A COMMERCIAL NUCLEAR
REACTOR OR WHICH MIGHT BE REASONABLY EXPECTED TO HOST
EVACUEES FROM ANOTHER JURISDICTION WITHIN A PLUME OR
INGESTION ZONE SHALL SUBMIT TO THE STATE DIRECTOR A
RADIOLOGICAL EMERGENCY RESPONSE PLAN. THE EMERGENCY
RESPONSE PLAN FOR A JURISDICTION WITHIN A PLUME ZONE SHALL
PROVIDE FOR EVACUATION OF THE RESIDENTS OF THE POLITICAL
SUBDIVISION AS A RESULT OF AN EMERGENCY OR MAJOR DISASTER
CAUSED BY A DANGEROUS RELEASE OF RADIATION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.
