Ch. 610

vote on this proposed amendment to the Constitution shall be
by ballot, and upon each ballot there shall be printed the
words "For the Constitutional Amendments" and "Against the
Constitutional Amendments," as now provided by law.
Immediately after the election, all returns shall be made to
the Governor of the vote for and against the proposed
amendment, as directed by Article XIV of the Constitution,
and further proceedings had in accordance with Article XIV.

CHAPTER 611

(House Bill 724)

AN ACT concerning

Pension Systems - Accidental Disability Allowance

FOR the purpose of prohibiting an accidental disability
allowance for a disability incurred prior to enrollment
in the State Employees' or Teachers' Pension Systems;
and correcting language.

BY repealing and reenacting, with amendments,

Article 73B - Pensions

Section 117(5)(b) and (7), 145(5)(b) and (7), and

156(b)
Annotated Code of Maryland
(1978 Replacement Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 73B - Pensions

117.

(5) (b) In no event shall a member receive a
disability allowance for a disability incurred prior to
enrollment in the [retirement] PENSION system, except to the
extent that such a disability was aggravated subsequent to
the member's enrollment.

(7) (A) On the application of a member or of the head
of his department, any member who has been totally and
permanently incapacitated for duty as the natural and
proximate result of an accident that occurs while in the
actual performance of duty at some definite time and place,
without willful negligence on his part, shall be retired by
the board of trustees, if the medical board certifies that
