Article 27 - Crimes and Punishments

Annotated Code of Maryland

(1976 Replacement Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 27 - Crimes and Punishments

142A 145.

(a) For the purposes of this section:

(2) "Credit card" means an instrument or device,
whether known as a credit card, credit plate, DEBIT CARD,
ACCESS CARD, or by any other name, issued by an issuer for
the use of the cardholder in obtaining money, goods,
services or anything else of value [on credit] OR

EFFECTING OTHER PERSONAL FINANCIAL TRANSACTIONS. IT

INCLUDES A DEBIT OR ACCESS CARD OR OTHER DEVICE OTHER THAN A
CHECK, DRAFT OR SIMILAR PAPER INSTRUMENT USED BY THE
CARDHOLDER TO EFFECT A TRANSFER OF FUNDS THAT IS INITIATED
THROUGH AN ELECTRONIC TERMINAL, TELEPHONE, OR COMPUTER, OR
MAGNETIC TAPE ORDERING, INSTRUCTING OR AUTHORIZING A
FINANCIAL INSTITUTION TO DEBIT OR CREDIT AN ACCOUNT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.

AN ACT concerning

Department of Fiscal Services - Audits

FOR the purpose of correcting and clarifying the law
describing the kinds of post audits made by the
Legislative Auditor of State agencies and other
entities; redescribing the agencies and other entities
audited, the frequency, content, and implementation of
audit reports; specifying the manner of access to
records to be audited and the confidential nature of
these records; specifying the duties of persons and
agencies being audited and the legal process for
producing audit records; providing penalties for
violations; and specifying the details of performing
audits by the Legislative Auditor.
