SECTION 4. AND BE IT FURTHER ENACTED, That on July 1,
1980 Section 2 of this Act shall take effect and the
provisions of Section 1 of this Act shall be abrogated
without further action by the General Assembly.

AN ACT concerning

Franchises

FOR the purpose of regulating the keeping of business
records by certain franchisors, providing for
inspection of those records; limiting advertising by
franchisors under certain circumstances; and providing
for suits against and service of process on certain
franchisors.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 56 - Licenses

349.

The application for registration of an offer consists
of an offering prospectus which shall be filed with the
Commissioner and contain the following:

(23)  AN AUTHORIZATION FOR THE COMMISSIONER TO
EXAMINE THE REGISTRANT'S FINANCIAL RECORDS OF THE SALE OF
FRANCHISES.

(24)  AN IRREVOCABLE CONSENT TO SUIT IN THIS
STATE AND APPOINTMENT OF THE COMMISSIONER AS ATTORNEY TO
RECEIVE SERVICE OF PROCESS ON THE FRANCHISOR'S BEHALF.
