CHAPTER 582

(Senate Bill 953)

AN ACT concerning

Public Ethics Law - Contingent Compensation

FOR the purpose of permitting the appearance of certain
officials or employees under the Maryland Public Ethics
Law before the Maryland Automobile Insurance Fund
certain agencies; and clarifying language.

BY repealing and reenacting, with amendments,

Article 40A - Maryland Public Ethics Law

Section 3-103

Annotated Code of Maryland

(1978 Replacement Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 40A - Maryland Public Ethics Law

3-103.

(a)  An official or employee, except a member of the
General Assembly, may not be employed by, or have an
interest in, any entity subject to the authority of that
official or employee or of the government agency with which
he is affiliated or by any entity which is negotiating or
has entered a contract with that government agency. This
prohibition does not apply to a public official who is
appointed to a regulatory or licensing authority pursuant to
a statutory requirement that persons subject to the
jurisdiction of the authority be represented in appointments
to it.

(b)  A former official or employee, except a former
member of the General Assembly, may not assist or represent
another party other than the State for compensation in a
case, contract, or other specific matter involving the State
government if that matter is one in which he significantly
participated as an official or employee.

(c)  An official or employee may not assist or
represent a party for contingent compensation in any matter
before or involving any agency other than a judicial agency,
[or] the Workmen's Compensation Commission, THE MARYLAND

AUTOMOBILE INSURANCE FUND, THE METROPOLITAN TRANSIT

AUTHORITY, THE CRIMINAL INJURIES COMPENSATION BOARD, or if
permitted by law or regulation, before an agency or a

quasi judicial agency of the State or a political

subdivision. OF THE STATE OR A POLITICAL SUBDIVISION OTHER
