LAWS OF MARYLAND

Ch. 576

Bay-wide management to meet the long-term needs of the
people of both Maryland and Virginia; and

WHEREAS, Effective cooperation in and coordination of
Bay management has been stressed by the Commission, and
reports by citizen groups, the participants in the Bistate
Conference on the Chesapeake Bay, and many other analyses
directed toward optimal long-term balance in the management
of the Chesapeake Bay; and

WHEREAS, The State and the Commonwealth share the
primary responsibility for the management of the Bay and
activities affecting it; and

WHEREAS, The Commission has found that the provisions
of this Agreement would enhance the ability of the
respective state legislatures to evaluate and respond to
problems of Bay-wide concern; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Natural Resources

CHESAPEAKE BAY COMMISSION

ARTICLE I

MEMBERSHIP AND ORGANIZATION.

8-302.

1.  COMMISSION CREATED.

THE CHESAPEAKE BAY COMMISSION, HEREINAFTER DESIGNATED
AS "COMMISSION", IS HEREBY CREATED.

2.  MEMBERS.

THE COMMISSION SHALL CONSIST OF FOURTEEN MEMBERS, SEVEN
FROM VIRGINIA AND SEVEN FROM MARYLAND. IN EACH STATE, FIVE
OF THE MEMBERS SHALL BE MEMBERS OF THE GENERAL ASSEMBLY. IN
MARYLAND, TWO SENATORS DESIGNATED BY THE PRESIDENT OF THE
SENATE AND THREE DELEGATES DESIGNATED BY THE SPEAKER OF THE
HOUSE SHALL SERVE AS MEMBERS. THE GOVERNOR OF MARYLAND OR
HIS DESIGNEE SHALL SERVE AS A MEMBER. IN ADDITION, THE
PRESIDENT OF THE SENATE AND THE SPEAKER OF THE HOUSE OF
DELEGATES SHALL JOINTLY SELECT TWO MARYLAND MEMBERS WHO ARE
NOT LEGISLATORS ONE MARYLAND MEMBER WHO IS NOT A LEGISLATOR
OR AN EMPLOYEE OF THE EXECUTIVE BRANCH . IN VIRGINIA, TWO
SENATORS DESIGNATED BY THE COMMITTEE ON PRIVILEGES AND
ELECTIONS AND THREE DELEGATES DESIGNATED BY THE SPEAKER OF
THE HOUSE OF DELEGATES SHALL SERVE AS MEMBERS. THE GOVERNOR
OF VIRGINIA OR HIS DESIGNEE SHALL SERVE AS A MEMBER. IN
ADDITION, THE SENATE COMMITTEE ON PRIVILEGES AND ELECTIONS
AND THE SPEAKER OF THE HOUSE OF DELEGATES SHALL JOINTLY
SELECT TWO ONE VIRGINIA MEMBERS MEMBER WHO ARE IS NOT
