(Senate Bill 378)

AN ACT concerning

District Court - Disposition of Fines and Costs on
Appeals to Circuit Court

FOR the purpose of providing for the transmittal of fines
and costs to the circuit courts on certain appeals from
the District Court; providing for payment of fines to
the counties on appeals from the District Court in
certain cases; and generally reorganizing statutory
provisions dealing with disposition of fines and costs
on appeals from the District Court.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Courts and Judicial Proceedings

[7-206.

(a)  If a criminal or traffic case is heard de novo by
a Circuit Court, a fine imposed by that court shall be paid
to the local government of the county in which the circuit
court sits.

(b)  If a criminal or traffic case is not heard de novo
by the circuit court or the case is dismissed, the fine
previously paid shall be disposed of in accordance with the
law governing disposition of fines in the District Court.
