multiple mutuel pools. Regular mutuel pool means a separate
wagering pool in which an interest is represented by a
single ticket evidencing a single wager on one horse.
Multiple mutuel pool means a separate wagering pool in which
an interest is represented by a single wager on two or more
horses. For the purpose of enforcing the provisions of this
section, the Commission shall have and exercise all of the
power conferred upon it by §§ 11 and 13 of this article.
EFFECTIVE JANUARY 1, 1982, THE AMOUNT OF TAX ON ALL MONEY
WAGERED ON ALL RACES CONDUCTED BY LICENSEES UNDER THE
PROVISION OF SECTION 15 SHALL BE ALLOCATED AS FOLLOWS:

(1) 4.50 PERCENT TO THE MARYLAND RACING

COMMISSION FOR USE BY THE STATE.

(2) 11.50 PERCENT OF ALL MONEYS WAGERED IN ALL
THE REGULAR MUTUEL POOLS, 14.50 PERCENT OF ALL MONEYS
WAGERED IN ALL MULTIPLE MUTUEL POOLS INVOLVING TWO HORSES,
AND 20.50 PERCENT OF ALL MONEYS WAGERED IN MULTIPLE MUTUEL
POOLS INVOLVING THREE OR MORE HORSES TO THE LICENSEE.

(b) (1) Each licensee licensed under the provisions of
this section shall at its option be permitted to avail
itself of the pari-mutuel betting privileges granted in this
section, retaining for its own use 13 1/2% of the regular
mutuel pool, 15.5 percent of the two horse multiple mutuel
pool, if any, and 21 1/2 percent of the three or more horse
multiple mutuel pool, if any, of all money wagered not in
excess of $125,000 daily average and 11 percent of the
regular mutuel pool and 13 percent of the two horse multiple
mutuel pool, if any, and 19 percent of the three or more
horse multiple mutuel pool, if any, of all money wagered in
excess of $125,000 daily average on all races conducted by
it during the year. Each licensee shall pay to the Harness
Racing Board for the use of the State an annual tax at the
rate of 3 1/2% of all money wagered not in excess of
$125,000 daily average, and 6% of all money wagered in
excess of $125,000 daily average on all races conducted by
it during the year. EFFECTIVE JANUARY 1, 1982, THE
PERCENTAGE AMOUNT OF ALL MONEYS IN EXCESS OF $125,000 DAILY
AVERAGE RETAINED BY THE LICENSEE SHALL BE 10.5 PERCENT OF
THE REGULAR MUTUEL POOL, 12.5 PERCENT OF THE TWO HORSE
MULTIPLE MUTUEL POOL, AND 18.5 PERCENT OF THE THREE OR MORE
HORSE MULTIPLE MUTUEL POOL, AND PAID TO THE HARNESS RACING
BOARD FOR USE OF THE STATE SHALL BE 6.5 PERCENT.

SECTION 2 AND BE IT FURTHER ENACTED, That this Act is
hereby declared to be an emergency measure and necessary for
the immediate preservation of the public health and safety
and having been passed by a yea and nay vote supported by
three-fifths of all the members elected to each of the two
Houses of the General Assembly, the same shall take effect
from the date of its passage.
