CHAPTER 552

(Senate Bill 317)

AN ACT concerning

Juvenile Causes - Intake Officers' Decisions

FOR the purpose of specifying the persons who are to be
notified of certain decisions of juvenile intake
officers; specifying certain persons that have the
right to appeal certain decisions of juvenile intake
officers; and making technical corrections.

BY repealing and reenacting, with amendments,

Article - Courts and Judicial Proceedings
Section 3-801 and 3-810(c), (g), (h), and (i)
Annotated Code of Maryland
(1974 Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Courts and Judicial Proceedings

3-801.

(a)  In this subtitle, the following words have the
meanings indicated, unless the context of their use
indicates otherwise:

(b)  "Adjudicatory hearing" means a hearing to
determine whether the allegations in the petition, other
than allegations that the child requires the court's
assistance, treatment, guidance or rehabilitation, are true.

(c)  "Adult" means a person who is 18 years old or
older.

(d)  "Child" means a person under the age of 18 years.

(e)  "Child in need of assistance" is a child who
requires the assistance of the court because

(1)  He is mentally handicapped or is not
receiving ordinary and proper care and attention, and

(2)  His parents, guardian, or custodian are
unable or unwilling to give proper care and attention to the
child and his problems provided, however, a child shall not
be deemed to be in need of assistance for the sole reason he
is being furnished nonmedical remedial care and treatment
recognized by State law.
