CHAPTER 466

(House Bill 1403)

AN ACT concerning

Calvert County - Stormwater Management Districts

FOR the purpose of requiring the County Commissioners of
Calvert County to determine whether interest shall be
charged property owners along with payments of the
costs for a stormwater management repair or
construction project; requiring the County
Commissioners of Calvert County to adopt by ordinance,
a comprehensive stormwater management plan under
certain circumstances; excluding certain interest and
other charges from the benefit charge fixed and levied
upon real property to meet the costs of a stormwater
management construction project; providing for the
maintenance of the drainage system; and relating
generally to stormwater management districts in Calvert
County.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 25 - County Commissioners

155B.

(A) THE COUNTY COMMISSIONERS OF CALVERT COUNTY, BY
ORDINANCE, MAY PROVIDE FOR THE ESTABLISHMENT OF STORMWATER
MANAGEMENT DISTRICTS. PRIOR TO THE ADOPTION OF AN ORDINANCE
ESTABLISHING STORMWATER MANAGEMENT DISTRICTS, THE COUNTY
COMMISSIONERS SHALL ADOPT BY ORDINANCE, A COMPREHENSIVE
STORMWATER MANAGEMENT PLAN. TWO-THIRDS OF THE PROPERTY
OWNERS, OR THE OWNERS OF TWO-THIRDS OF THE PROPERTY WITHIN
THE AREA AFFECTED (DEFINED FOR THIS SECTION AS THE CRITICAL
AREA GENERATING THE RUN-OFF WATER AND ALL OF THE AREA
FLOODED) MAY PRESENT A WRITTEN PETITION TO THE COUNTY
COMMISSIONERS REQUESTING THE CREATION OF A STORMWATER
MANAGEMENT DISTRICT AND A STORMWATER MANAGEMENT PROJECT.
