HARRY HUGHES, Governor                              1469

imposition and collection of the development tax and that
any tax collected pursuant to the provision of Chapter 702
of the Acts of 1979 which is in excess of the tax that would
be imposed pursuant to this Act be refunded to the taxpayer,
with interest, at the rate of 8 percent per annum.

SECTION 3. AND BE IT FURTHER ENACTED, That if any
provision of this Act or the application thereof to any
person or circumstance is held invalid for any reason in a
court of competent jurisdiction, the invalidity does not
affect other provisions or any other application of this Act
which can be given effect without the invalid provision or
application, and for this purpose the provisions of this Act
are declared severable.

SECTION 4. AND BE IT FURTHER ENACTED, That this Act
shall take effect June 1, 1980.

AN ACT concerning

County Superintendent of Schools - Term and Reappointment

FOR the purpose of providing certain procedures for the
appointment of a county superintendent of schools;
requiring certain notifications by a certain date; and
relating generally to appointment of county
superintendents and interim county superintendents; and
making this Act an emergency measure.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

4-201.

(a) This section does not apply to Baltimore City.
