(G) COUNTY.

"COUNTY" MEANS A COUNTY OF THIS STATE AND, UNLESS
OTHERWISE INDICATED, BALTIMORE CITY.

REVISOR'S NOTE: This subsection is new language added
to indicate that a reference in this article to
"county" includes Baltimore City, unless the
reference specifically provides otherwise.

Art. 1, § 14 of the Code provides that "county"
includes Baltimore City "unless such construction
would be unreasonable". However, the
"unreasonable" language of that section has been
interpreted in various ways. Therefore, the
Commission to Revise the Annotated Code concluded
that a more explicit definition should be
included here.

(H) FINANCIAL INSTITUTION.

"FINANCIAL INSTITUTION" MEANS ANY FINANCIAL INSTITUTION
OF THE TYPE SUPERVISED UNDER THIS ARTICLE, WHETHER OR NOT
STATE-CHARTERED.

REVISOR'S NOTE: This subsection is new language added
for clarity.

(I) INCLUDES; INCLUDING.

"INCLUDES" OR "INCLUDING" MEANS INCLUDES OR INCLUDING
BY WAY OF ILLUSTRATION AND NOT BY WAY OF LIMITATION.

REVISOR'S NOTE: This subsection is new language added
to state expressly that words such as "includes"
or "including" are used in this article by way of
illustration or expansion and not by way of
limitation or restriction.

In light of this definition, phrases such as "but
not limited to" are deleted throughout this
article as superfluous.

The Commission to Revise the Annotated Code would
emphasize, however, that the absence of a like
definition in any previously revised article of
the Code does not mean that "includes" or
"including" is used there in any different sense
or that a different legislative intent is implied
by the absence of phrases such as "but not
limited to". In these revised articles of the
Code, the maxim of expressio unius est - exclusio
alterius and doctrines of similar implication are
not intended in any way to be made applicable by
reason of the deletion of such phrases.
