AN ACT concerning

Comprehensive Health Planning - Appeal Procedures

FOR the purpose of establishing certain time requirements
for appeals from decisions of the Maryland Health
Planning and Development Agency; and requiring the
compilation of a record of proceedings by the Maryland
Health Planning and Development Agency.

BY repealing and reenacting, with amendments,

Article 41 - Governor - Executive and Administrative

Departments
Section 59L

Annotated Code of Maryland
(1978 Replacement Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 41 - Governor - Executive and Administrative
Departments

59L.

(a) Notwithstanding any other provision of law, an
aggrieved party may appeal a decision of the State agency to
the Secretary WITHIN 60 30 DAYS AFTER THE DATE OF THE
DECISION. FOR PURPOSES OF THIS PARAGRAPH AN APPEALABLE
DECISION SHALL INCLUDE DETERMINATIONS OF THE STATE AGENCY IN
ANY APPROPRIATENESS REVIEW MANDATED BY THE FEDERAL ACT
WHEREBY A PARTY IS AGGRIEVED. NOTICE OF APPEAL SHALL BE IN
WRITING AND SHALL BE SERVED ON THE SECRETARY AND THE STATE
AGENCY. The Secretary shall PROMPTLY notify all persons who
were parties to the agency decision of the pendency of any
appeal.

(B) WITHIN 30 DAYS AFTER RECEIPT OF NOTICE OF APPEAL,
THE STATE AGENCY SHALL SUBMIT THE RECORD OF PROCEEDINGS TO
THE SECRETARY. FOR PURPOSES OF THIS PARAGRAPH, THE RECORD
OF PROCEEDINGS SHALL INCLUDE:
