LAWS OF MARYLAND

Ch. 406

FOR the purpose of providing that certain designated
beneficiaries of volunteer and professional firemen and
rescue squad members fireman receive a certain amount
in death benefits from the State under certain
circumstances.

BY repealing and reenacting, with amendments,

Article 41 - Governor-Executive and Administrative

Departments
Section 59A-l(a)
Annotated Code of Maryland
(1978 Replacement Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 41 - Governor-Executive and Administrative
Departments

59A-1.

(a) (1) A death benefit shall be paid to the surviving
spouse, children, or designated beneficiary of any law
enforcement officer of the State or of any political
subdivision of the State, [or] any sheriff or deputy
sheriff, OR ANY VOLUNTEER FIREMAN OR PROFESSIONAL FIREMAN OR
RESCUE SQUAD MEMBER who is killed in the performance of
duties ON OR AFTER JANUARY 1, 1980. The amount of the
benefit shall be $25,000, less any amount received by that
person from:

(i) Any lump-sum death benefit payable by
the State or any political subdivision, exclusive of any
return of contributions, or,

(ii) The present value of any benefit
payable under the provisions of Article 73B, § 11(11)(b) of
the Code.

(2) This sum shall be in addition to any:

(i) Workmen's compensation benefits; or

(ii) Proceeds of any form of life
insurance, regardless of who paid the premiums on the
insurance.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.
