(ii) After a hearing is provided under
Title 12, Subtitle 2 of this article, may suspend the
license to drive of that person.]
17-106.
(a) If the required security for any vehicle
terminates or otherwise lapses at any time, the registration
of that vehicle:
(1) Is suspended automatically as of the date of
termination or lapse; and
(2) Remains suspended until the required
security is replaced.
(b) Each insurer or other provider of required
security immediately shall notify the Administration of the
termination or other lapse of any required security issued
to or provided for a resident of this State.
(c) On receipt of a notice under subsection (b) of
this section, the Administration shall make a reasonable
effort to notify the owner of the vehicle that his
registration has been suspended.
(d) (1) Within 48 hours after an owner is notified by
the Administration of the suspension of registration, the
owner shall surrender all evidences of that registration to
the Administration.
(2) If the owner fails to surrender the
evidences of registration within the 48-hour period, the
Administration:[:
(i) Shall] (i) SHALL attempt to recover
from the owner the evidences of registration; and [; and
(ii) May suspend his license to drive for
a period of not more than 1 year].
(II) MAY SUSPEND HIS LICENSE TO DRIVE
UNTIL HE RETURNS TO THE MOTOR VEHICLE ADMINISTRATION THE
EVIDENCES OF REGISTRATION.
(e) (1) In addition to any other penalty provided for
in the Maryland Vehicle Law, if the required security for a
vehicle terminates or otherwise lapses during its
registration year, the Administration may assess the owner
of the vehicle with a penalty of up to $100 for each vehicle
without the required security.
(2) A penalty assessed under this subsection
shall be paid to the uninsured section of the Maryland
Automobile Insurance Fund except that the Administration may
deduct 10 percent of the amount collected under this
section in any year to cover its costs before remitting the
balance.
