(2)  The Secretary shall satisfy himself that the
actions of the foster parents did not contribute
substantially to the bodily injury or property damage
sustained.

(3)  Reimbursement shall be made for all costs
[in excess or $100] to a maximum amount of $5,000. However,
the Board of Public Works shall approve all payments in
excess of $500

(c) In this section, "foster parents" includes parents
who care for children on an emergency basis under a program
of shelter care.

AN ACT concerning

Medical Care Programs - Subrogation

FOR the purpose of requiring that any funds received by an
indigent or medically indigent person or their attorney
by means of a judgment, award, or settlement resulting
from a cause of action be held for the benefit of the
Department of Health and Mental Hygiene to the extent
of any payment made by the Department resulting from
that occurrence; providing for deductions; establishing
a legal cause of action against certain persons who,
after receiving certain notice, violate this section;
and allowing the Department of Health and Mental
Hygiene to compromise an action.

BY repealing and reenacting, with amendments,
