AN ACT concerning

Payments for Elderly and Disabled Renters - Definition
of Disabled Renter

FOR the purpose of clarifying the definition of a disabled
renter.

BY repealing and reenacting, with amendments,

Article 81 - Revenue and Taxes

Section 12F-3(a)(8)

Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 81 - Revenue and Taxes

12F-3.

(a) In this section, the following words have the
meanings indicated:

(8) "Renter" means every person who is 60 years
of age or older or who [is disabled as defined in Section
12F-1 of this article] QUALIFIED FOR BENEFITS AS A RESULT OF
A FINDING OF PERMANENT AND TOTAL DISABILITY UNDER THE SOCIAL
SECURITY ACT, THE RAILROAD RETIREMENT ACT, ANY FEDERAL ACTS
FOR MEMBERS OF THE ARMED FORCES OF THE UNITED STATES, OR ANY
OTHER FEDERAL RETIREMENT SYSTEM, OR BY THE COUNTY HEALTH
OFFICER OR COMMISSIONER OF HEALTH OF BALTIMORE CITY, and
who, during the calendar year for which the credit is to be
allowed, actually resides in a dwelling in which he then had
a leasehold interest. Leasehold interest includes any joint
tenancy, tenancy in common, tenancy by the entireties, or
through membership in a cooperative which is leasing the
premises.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.
