(i) A hearing is not requested; or

(ii) After a hearing, the Board finds that
the institution does not meet the conditions or standards.

(2) The order takes effect 15 days after it is
issued.

(i) (1) An institution has the right to judicial
review of any State Board determination under this section
as provided by the Administrative Procedure Act.

(2)  The decision of the State Board is presumed
correct and proper and the institution has the burden of
proving otherwise.

(3)  The State Board shall be a party to the
proceeding.

(j) A noncollegiate educational institution shall:

(1)  Be open for inspection by the State
Superintendent or his designee at all reasonable times; and

(2)  Furnish the reports and information required
by the State Superintendent on the forms provided by the
State Superintendent.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.

AN ACT concerning

Creation of a State Debt - Somerset County Jail

FOR the purpose of authorizing the creation of a State debt
in the amount of $1,000,000 $1,500,000, the proceeds to
be used to assist in the construction and equipping of
a Somerset County Jail Facility, subject to the
provision by the County Commissioners of Somerset
County of at least an equal and matching fund for the
same purpose; and providing generally for the issue and
sale of bonds evidencing the loan.
