AN ACT concerning

Energy Conservation Devices - Property Covenants

FOR the purpose of preventing private land use restrictions
from frustrating the use of alternative energy systems
by landowners by prohibiting unreasonable restrictions
on the installation of solar collection panels by
landowners; and providing a certain exception.

Section 2-119

Annotated Code of Maryland

(1974 Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Real Property

2-119.

EXCEPT AS PROVIDED IN THIS SECTION,

(1)  AN EXISTING OR FUTURE A RESTRICTIVE COVENANT
REGARDING LAND USE, WHICH BECOMES EFFECTIVE AFTER JULY 1,
1980, MAY NOT IMPOSE OR ACT TO IMPOSE UNREASONABLE
LIMITATIONS ON THE INSTALLATION OF SOLAR COLLECTION PANELS
ON THE ROOF OR EXTERIOR WALLS OF IMPROVEMENTS.

(2)  THIS SECTION DOES NOT APPLY TO A RESTRICTIVE
COVENANT ON HISTORIC PROPERTY THAT IS LISTED BY:

(I)  THE MARYLAND INVENTORY OF HISTORIC
SITES; OR

(II)  THE MARYLAND LANDMARKS LIST.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.
