CHAPTER 377

(House Bill 204)

AN ACT concerning

Jurisdiction Over Juveniles

FOR the purpose of altering the jurisdiction of certain

courts over certain juveniles who have committed

certain crimes; and making stylistic changes providing
that the Juvenile Court does not have jurisdiction over
certain children alleged to have committed or attempted
to commit robbery with a dangerous weapon.

BY repealing and reenacting, with amendments,

Article - Courts and Judicial Proceedings

Section 3-804(d)

Annotated Code of Maryland

(1974 Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Courts and Judicial Proceedings

3-804.

(d) The court does not have jurisdiction over:

(1)  A child 14 years old or older alleged to
have done an act which, if committed by an adult, would be a
crime punishable by death or life imprisonment, as well as
all other charges against the child arising out of the same
incident, unless an order removing the proceeding to the
court has been filed [pursuant to § 594A of Article 27]
UNDER ARTICLE 27 § 594A;

(2)  A child 16 years old or older alleged to
have done an act in violation of any provision of the
Transportation Article or other traffic law or ordinance,
except an act that prescribes a penalty of incarceration;

(3)  A child 16 years old or older alleged to
have done an act in violation of any provision of law, rule
or regulation governing the use or operation of a boat,
except an act that prescribes a penalty of incarceration;

(4)  A child 16 years old or older alleged to
have committed the crime of robbery with a DANGEROUS OF
deadly weapon or attempted robbery with a DANGEROUS OR
deadly weapon OR ALLEGED TO HAVE COMMITTED THE CRIME OF
